General Terms and Conditions of Sale (GTCS)

1. Purpose & Scope
   These GTCS govern the subscription by professional customers to the online application PermaTechnics, to the exclusion of any other conditions.
2. Access & Services
   Access to the Application is granted after payment of the annual subscription or of the first monthly instalment. The login details are personal and confidential.
3. Price & Payment
   The monthly and annual subscription rates (excl. VAT) are shown on the application’s website: www.permatechnics.com. Final access to the application takes effect after the free month, once payment has been made by debit/credit card.
4. Term & Renewal
   The paid subscription is entered into for a term of 12 months, paid in one annual payment or in 12 monthly instalments. It renews tacitly for 12 months. The Client may terminate it in the application no later than 30 days before the renewal date; the subscription runs until that date. With monthly payment, all monthly instalments up to the end of the 12 months remain due, even after termination. No partial refund is granted.
5. Price changes
   The Publisher may change its rates. A new rate applies to the Client from the renewal date of their subscription, never during a current 12-month period. Any price increase is notified to the Client at least 2 months before that date, by email and in the application, with the new price, its effective date and how to terminate. A Client who refuses the increase may terminate under the “Term & Renewal” article. A price decrease applies automatically at renewal.
6. Termination
   The Publisher may terminate for non-payment or serious breach. Access is suspended immediately for as long as the payment relating to the subscription period has not been made.
7. Obligations of the Client
   The Client undertakes to use the Application in a compliant manner, not to infringe the Publisher’s rights and not to attempt unauthorised access.
8. Intellectual property
   The Application and its content are protected. The Client has only a limited, non-exclusive and non-transferable right of use.
9. Liability
   Service provided “as is”. The Publisher uses reasonable means to ensure availability, without any guarantee of continuous access. Liability is limited to direct damage, capped at the amount of the annual subscription. No indirect damage is compensable.
10. Force majeure
    The Publisher is not liable in the event of force majeure within the meaning of the applicable law.
11. Data protection
    Personal data is processed in accordance with the GDPR. See the Privacy Policy on www.permatechnics.com.
12. Applicable law & jurisdiction
    The GTCS are governed by Belgian law. Any dispute falls within the jurisdiction of the courts of the Publisher’s registered office, unless a mandatory legal provision provides otherwise.
