General Terms and Conditions of Sale (GTCS)

PermaTechnics, application developed and marketed by Consilium srl, VAT BE0678.957.735

1. Purpose & Scope
   These GTCS govern the subscription by professional customers to the online application PermaTechnics, to the exclusion of any other conditions.
2. Access & Services
   Access to the Application is granted after payment of the annual subscription or of the first monthly instalment. The login details are personal and confidential.
3. Price & Payment
   The monthly and annual subscription rates (excl. VAT) are shown on the application’s website: www.permatechnics.com. Final access to the application takes effect after the free month, once payment has been made by debit/credit card.
4. Term & Renewal
   The subscription is entered into for a period of 1 month or 12 months. The Client may terminate it themselves in the application; the subscription will run until its renewal date. Any subscription period that has begun remains due, and no partial refund is granted.
5. Termination
   The Publisher may terminate for non-payment or serious breach. Access is suspended immediately for as long as the payment relating to the subscription period has not been made.
6. Obligations of the Client
   The Client undertakes to use the Application in a compliant manner, not to infringe the Publisher’s rights and not to attempt unauthorised access.
7. Intellectual property
   The Application and its content are protected. The Client has only a limited, non-exclusive and non-transferable right of use.
8. Liability
   Service provided “as is”. The Publisher uses reasonable means to ensure availability, without any guarantee of continuous access. Liability is limited to direct damage, capped at the amount of the annual subscription. No indirect damage is compensable.
9. Force majeure
   The Publisher is not liable in the event of force majeure within the meaning of the applicable law.
10. Data protection
    Personal data is processed in accordance with the GDPR. See the Privacy Policy on www.permatechnics.com.
11. Applicable law & jurisdiction
    The GTCS are governed by Belgian law. Any dispute falls within the jurisdiction of the courts of the Publisher’s registered office, unless a mandatory legal provision provides otherwise.
